Dear Mr Wilkes,

Subject: Care of Mrs Evelyn Lovelock and www.NHSCare.info

Many Thanks for your reply dated 27 March to my letter ref NHSC4 dated 12 March, in which you say that you will take no further action at this point.

May I remind you that, during the 22nd January meeting at Holyport Lodge, documented in HOLYP5 on the web sites above, you promised to provide me with a copy of Dr Van Wyk's report, after asking permission from Dr Van Wyk. Have you written to Dr Van Wyk, asking for his permission ? If not, why not ? If you have not, I would be grateful if you would do so, providing me with a copy of your letter to him, and informing me of his reply. I would be grateful for a copy of his report to you at your very earliest convenience.

You are correct that our main dispute is with the NHS, who should be paying 100% of the care home costs for cases such as my mother's. However, it is clear that Wokingham Social Services continue to deny that they have operated unlawfully, despite having been given over three months to consider my letters, including ANJU4 19 Nov 2002. Furthermore, I understand that you continue to flout the law in actions such as means testing of NHS patients and misinforming the public. I regret that you and your staff may be personally liable in any subsequent claims made by those wishing to recover care home costs. I therefore suggest that you and your staff obtain expert legal advice, perhaps via your union, if you have one. You may also wish to pass this letter to your legal department: I will be pleased to hear from them.

Please provide me with contact details for Anju Bhatti, who you contracted during the important period of my mother's assessment prior to discharge from Battle Hospital. We wish to discuss this subject with her also, since she is an important witness and/or defendent in any investigation or action.

Please thank Stuart Taylor of your Shute End office for his letter Ref 218978 dated 31st March, providing me with the total of £1924.12 claimed by Wokingham Unitary. You will note that my own claim against you is in Invoice ANNEB1 2nd Dec '02, accruing interest. Probate for my mother's estate is in progress, and when it is complete, I will consult my sister, Sally Campion, on what we do regarding this subject of unsettled invoices.

I request that you give these matters your most urgent attention. Nothing in this letter modifies or reduces in any way my claim for 'free continuing care' under the Coughlan Case for my mother.

Yours Sincerely,

Robin Lovelock

(son of Evelyn Lovelock and executor of her estate)
