Many Thanks for your letter of 26 January, providing me with such a prompt reply. I'm sorry that I did not mention that my mother is now in Holyport Lodge nursing home.

Unfortunately I believe you are incorrect in your statements about the NHS, and I hope the following paragraphs from my legal advisor, Derek Cole, will be of help to you.

My original statement of the law was correct - as you will see from the enclosed opinion from Mr Cole, who has very successfully represented many patients with conditions similar to my mother across the country. In effect, the Coughlan Case made the Sutherland report redundant as, by operation of law, its provisions are already for the most part in force.

The Government has taken great pains to try and prevent councillors of opposition parties from learning about this case.

I am very anxious to establish if the 'criteria' have been agreed by the SSDs involved and, if so, if my elected Councillors have been given a proper briefing. The 'criteria' are so sensationally unlawful that any such agreement would be 'ultra vires' and void. I would be grateful if you would let me know the position.

So far the question of Social Services interviewing my mother has been overcome, with me being present in the corridor, listening to what is being said.
